This information is ruled by EU Regulation 2016/679 (hereafter “European Regulation”) and by Legislative Decree 196/2003,
as amended by Legislative Decree 101/2018 (hereinafter “Privacy Code”) and concerns the treatment of personal data
(hereinafter “Personal Data” or “Data”) of Users who download Appeaty application (hereinafter the “Application”)
and create their own account for the use of the Application (hereinafter “User” or “Users”).
1. Owner of personal data treatment
Owner of Users' Personal Data treatment is Kemanji s.r.l. (below “Kemanji” or “Owner”), headquartered in Viale della Vittoria 369, 31029 Vittorio Veneto (TV), e-mail address info@kemanji.com.
2.Categories of Personal Data
Owner can collect and proceed the following Personal Data:
a) personal data and contacts, as name, surname, date of birth, e-mail address, telephone number;
b) tax code or VAT number for invoice issuing;
c) address for deliveries, when User requests for a delivery service;
d) bank account number (Iban), when User requests to pay what was ordered with the application by end of month direct debiting bank account;
e) geolocalization, when User decides to activate it on his mobile's settings;
f) food intolerances or allergies, unliked food and daily caloric requirements, when inserted by User.
3. Purpose and legal basis for data treatment
Owner collects the data mentioned under point 2 letters a), b), c) e d) to enable User to use the Application.
Their treatment is necessary to perform the contract between Owner and User therefore the services requested by User cannot be granted in absence of them.
User's e-mail address can be used to send advertising materials, upon agreement.
The data mentioned under point 2 letters e) and f) are treated, on User's consent basis, to improve the Application use: when these data are inserted, Application shows only the restaurants in the area where the User is or only the ones that provide food compatible with User's preferences.
Finally the data mentioned under point 2 letters f) can be used, in a later period, to perform statistical or scientific research.
These data will be anonymously treated, with technical and organisational measures as required by art. 89 of European Regulation and in accordance to Privacy Code.
4.Entities to whom Personal Data are shared
Personal Data can be shared with Kemanji employee, as authorised entities, with the external parties that supply the Owner the necessary services for the correct functioning of the Application, and with the restaurant selected by the User in the necessary measure to meet User's requests.
In addition, Personal Data can be shared in future, anonymously, to entities that perform scientific and statistical research as mentioned under point 3.
5.Data processing method and retention period
Personal Data are treated with automated tools, in a way to ensure maximum security and confidentiality, in a way to conduct the operations necessary to realise the aim strictly connected to the use of the Application.
Data will be retained for a period not longer than strictly necessary to achieve the purposes for which they were collected or treated and, in any case, in compliance with the regulations that enforce a specific retention period of certain types of Personal Data.
6. Individual's rights
User can exercise the rights mentioned from art. 15 to art. 22 of European Regulation at any time, in particular:
a) the right to request the Owner for the access to his Personal Data, for the correction and for the cancellation of them;
b) the right to restrict his Personal Data use in the cases mentioned under art. 18 of European Regulation;
c) the right to object to his Personal Data treatment in the cases mentioned under art. 21 paragraph 1 of European Regulation and, in any case, when Personal Data are treated for direct marketing puroposes;
d) the right to receive his Personal Data in a structured format, commonly used and readable by an automated device, and to transmit them to another personal data treatment owner without any impediment from Kemanji, as mentioned under art. 20 of European Regulation;
e) the right to withdraw the consent, when the Personal Data treatment was granted on a User's consent basis;
f) the right to lodge a complaint with the supervisory authority (AUTORITÀ GARANTE PER LA PROTEZIONE DEI DATI PERSONALI).
User can esercisse his rights freely and at any time by sending the Owner an e-mail to the following address: info@kemanji.com.
Please, note that User can modify his Personal Data through Application's settings at any time. Kemanji will provide the opportune feedback to User's feedback within a reasonable period not longer than a month.
